HB 20-- AN ACT relating to sales and use taxes.

This bill will exempt clothing, school supplies, and computers sold during the first week of August each year from the sales tax. It will allow retailers to absorb the sales tax on any other item sold during the first week of August each year.

HB 63-- AN ACT relating to highways.

Create a new section of KRS Chapter 189 to allow a county, by resolution of the fiscal court, to lower the weight or speed limits on a state highway with a weight limit of up to 44,000 pounds, subject to approval by the Transportation Cabinet, provide that the county bear the cost of installing and maintaining signs required by any changes made under the section, and set limits on minimum weight load reduction; amend KRS 189.230, 189.272, 189.280, and 189.990 to conform.

HB 65-- AN ACT relating to consumer protection.

Create a new section of KRS 434.550 to .730 relating to credit and debit cards to require that electronic cash registers and similar machines print not more than the last five digits of the credit or debit card number and not print the card expiration date on credit and debit card receipts. Does not apply to hand written receipts or to non electronic imprints of credit and debit cards. Effective January 1, 2003 for newly installed machines and January 1, 2005 for current machines.

Amend KRS 304.12-030 to bring annuities and variable insurance products under the scope of the current requirements for the replacement of life insurance; include within the definition of replaced policy an existing policy or contract that has been or is to be used in a financed purchase; amend KRS 304.15-700 to delete requirement for attendance at a pre-licensing training class for viatical settlement brokers; amend KRS 304.15-717 to prohibit an individual from viaticating a life insurance policy during the contestable period unless the violator certifies to the viatical settlement provider that enumerated conditions have been met.

Create new sections of KRS Chapter 40 to establish a burial honor guard program for veteran's funerals; establish the veterans' service organization burial honor guard trust fund to offset costs; authorize the Department of Veterans' Affairs to promulgate administrative regulations and coordinate efforts with the Department of Military Affairs, veterans' service organizations, Kentucky veterans and their dependents, the Kentucky Funeral Directors' Association, the United States Army Reserve, and the Casualty Assistance Commands of Fort Campbell and Fort Knox; authorize local school boards to provide academic credit and excused absences for secondary students participating in the burial honor guard program; create a new section of KRS Chapter 158 authorizing local school boards to provide academic credit and excused absences for secondary students participating in the burial honor guard program; EFFECTIVE JULY 1, 2002.

Create a new section of KRS 154A to require that lottery vending machines be placed in the cashier's direct line of sight except where the machines are located in factories or in bars or taverns where persons 18 years of age are not permitted access; amend KRS 154A.990 to provide for a civil fine of between $100 and $500 dollars for lottery retailers in violation.

HB 234-- AN ACT relating to office location of mortgage loan brokers.

Create a new section of KRS Chapter 294 to define "physical office" and require each licensed mortgage loan broker to maintain a physical office in Kentucky; allow 90 day period for compliance by brokers licensed on the effective date of the Act who do not currently maintain a physical office in Kentucky; amend KRS 294.032, relating to the application for a license and renewals, to include information on the location of the physical office location in Kentucky and whether the location is a residence; require photographs of exterior, interior, and exterior sign; require the lease of any non residence location to be for a term of at least 1 year; require proof of residence that must confirm the mortgage loan broker owns or leases the residence and lives in the residence as the broker's main residence; require at least 10 days' notice of the address change at the physical office location; amend KRS 294.034 to prohibit the commissioner from approving renewal of a license if the information on office locations is not received.

HB 235--AN ACT relating to mortgage loan business.

Amend KRS 294.010 to define "mortgage loan broker", "loan officer", and "loan processor"; amend KRS 294.020 to subject mortgage loan brokers regulated by the Department of Housing and Urban Development to the requirements of registration and continuing education; amend KRS 294.030 to require mortgage loan brokers and loan officers to register before originating loans; create a new section of KRS Chapter 294 to require mortgage loan brokers and loan officers to register with the Department of Financial Institutions annually; require loan officers when registering for the first time to complete a 12 hour course; establish a registration fee of $50; create a new section of KRS ch. 294 to create a new section of KRS Chapter 294 to require mortgage loan brokers and loan officers to complete 12 hours of continuing education annually; require the department to approve continuing education courses; require certification to the department of completion of continuing education courses; permit an extension of 1 year at the discretion of the commissioner to complete continuing education requirements; provide for termination of registration for failure to complete continuing education courses and provide for reinstatement of registration; provide a penalty for submitting false or fraudulent certificate of compliance; amend KRS 294.032 to clarify that the requirement of 30 hours training before a mortgage broker can be licensed means 30 classroom hours.

HB 684-- AN ACT relating to student financial aid.

Amend KRS 164.7535 to permit students enrolled in an equivalent undergraduate program as defined by the Council on Postsecondary Education to qualify for college access funds if otherwise qualified; amend KRS 164.7881 to permit students enrolled in an equivalent undergraduate program as defined by the Council on Postsecondary Education to use Kentucky educational excellence scholarship awards for which they are otherwise eligible; provide that the Act be retroactive to the 2001-2002 academic year.
